End User Terms of Service

By using any simulation funnel powered by Dupital, you agree to these Terms.

1. What This Service Is

1.1 AI Simulations

When you use a funnel on this platform, you can upload an image to receive an AI-generated simulation or transformation. These simulations are:

Illustrative visualisations only - not predictions of actual results
Created using artificial intelligence technology
Configured by the business operating this funnel

1.2 Important Disclaimers

Simulations are NOT medical, professional, or technical advice
Simulations do NOT guarantee or predict real-world outcomes
Actual results will vary from simulations
The business operating this funnel is responsible for any claims or context provided around the simulation

2. Eligibility

2.1 Age

This service is not designed for children under 18, and we do not knowingly collect data from children under 18. If you believe a child has used the service, contact privacy@dupital.com.

2.2 Geographic Restrictions

Some funnels may not be available in your location due to local laws or business restrictions.

3. Your Image Uploads

3.1 Your Rights and Responsibilities

By uploading an image, you confirm that:

You have the legal right to upload and use the image
The image does not violate anyone's privacy or publicity rights
The image does not contain illegal or harmful content

3.2 How Your Image Is Used

Your uploaded image will be:

Processed by AI to generate your simulation
Stored temporarily and deleted within 30 days
Reviewed by Dupital to monitor quality and improve the service
Not used for AI model training
Not shared with third parties for marketing

The generated simulation images (the AI output, not your original photo) are made available to the business operating the funnel within their account dashboard, so they can review results and follow up with you. Your original uploaded photo is not shared with the business.

If the funnel collects your contact details (name, email, phone), those details may also be shared with the business operating the funnel so they can follow up about your interest. This is described where the contact form is shown.

3.3 No Other Uses

Unless you explicitly opt in separately:

Your image will NOT be used for AI model training
Your image will NOT be used for marketing
Your image will NOT be sold to third parties

4. Data Controller

4.1 Who Controls Your Data

Dupital Ltd is the Data Controller for personal data collected through this funnel, including any uploaded image, technical request data, and (where collected) your contact details whilst they are held by Dupital.

Where the funnel collects contact details for the business operating it, that business becomes a separate Data Controller for the copy of those details once they are transferred to them. From that point on, the business is responsible for how they use, store, and respond to requests about their copy of the data.

4.2 Your Privacy Rights

You have rights regarding your personal data under UK GDPR, including:

Access to your data
Correction of errors
Deletion ("right to be forgotten")
Data portability
Objection to processing
Withdrawal of any consent you have given

5. Simulation Results

5.1 No Ownership Claims

You retain rights to your original image
The business operating the funnel may use simulations for the purposes described to you
Dupital claims no ownership of generated simulations

5.2 Use Restrictions

Do not use simulations to:

Mislead or deceive others
Make false claims about products or services
Violate any laws or regulations
Infringe on others' rights

6. Professional Disclaimer

Simulations are illustrative only and do not provide medical, dental, healthcare, legal, financial, engineering, or any other form of professional advice or consultation. Always consult qualified professionals for advice specific to your situation.

7. Lawful Basis

7.1 How We Process Your Data

Dupital relies on legitimate interests as the lawful basis under UK GDPR Article 6(1)(f) for processing your image and technical data to:

Generate your requested simulation
Maintain and improve the service
Prevent fraud and misuse

We have assessed that this processing is necessary, proportionate, and balanced against your rights. You can object to this processing at any time by contacting privacy@dupital.com.

7.2 Where Consent Applies

We rely on consent only where required, for example for optional marketing communications. Consent is always opt-in and can be withdrawn at any time.

8. Limitation of Liability

8.1 Service Provided "As Is"

THE SIMULATION SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE ACCURACY, AVAILABILITY, OR FITNESS FOR ANY PURPOSE.

8.2 Liability Limits

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Dupital is not liable for the accuracy of simulations
Dupital is not liable for how businesses use the platform
Neither Dupital nor the business is liable for indirect or consequential damages
Total liability is limited to £100 (or US$125 for US residents)

8.3 Exceptions

Nothing limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

9. Intellectual Property

9.1 Platform Technology

The Dupital platform, including its technology and user interface, is owned by Dupital Ltd or its licensors.

9.2 Business Content

Content specific to this funnel (prompts, configurations, branding) belongs to the business operating it.

9.3 Your Content

You retain rights to images you upload, subject to the processing licence you grant by using the service.

10. Third-Party Services

This funnel may integrate with third-party services for payment processing, communications, and analytics. These services have their own terms and privacy policies. See our Sub-Processors page for the current list.

11. Changes to Terms

These Terms may be updated periodically. Continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
